A magistrate's court in Yala, Siaya County, has issued an arrest warrant for a clinician accused of defiling a 14-year-old girl after he failed to appear in court for plea taking.
The warrant was issued following an application by the prosecution, which asked the court to compel the accused to appear and respond to the charges brought against him.
The clinician is accused of sexually abusing the minor in an incident that allegedly took place over several months in Gem, Yala Sub-County, within Siaya County.
According to the charge sheet, the alleged offence occurred on diverse dates between January 2026 and August 23, 2026, involving a girl aged 14 years.
The accused faces a principal charge of defilement contrary to Section 8(1), as read with Section 8(3) of the Sexual Offences Act No. 3 of 2006.
The prosecution has also listed an alternative charge of committing an indecent act with a child contrary to Section 11(1) of the same Act.
The court's decision to issue the warrant followed the accused's failure to attend the scheduled plea-taking session, prompting the prosecution to seek his arrest to ensure that the case proceeds.
The warrant allows law enforcement officers to apprehend him and present him before the court, where he will be required to take a plea and respond to the allegations.
Under Kenya's Sexual Offences Act, defilement is a serious criminal offence, with the punishment varying depending on the age of the child involved.
Section 8 of the Act provides for severe penalties for individuals found guilty of sexually abusing children. In cases involving victims aged between 12 and 15 years, the law provides for a minimum sentence of 20 years' imprisonment upon conviction.
The law also criminalises indecent acts involving children, with Section 11(1) providing for a separate penalty for anyone found guilty of the offence.
The allegations against the clinician will now be subject to the court process, with the prosecution expected to present its case once the accused appears before the court.
The issuance of the arrest warrant marks a step towards ensuring that the accused is brought before the court to answer to the charges.
The matter is scheduled for mention on November 11, 2026, when the court is expected to receive an update on the case and the execution of the arrest warrant.
