The Deputy Speaker of the Trans Nzoia County Assembly and Matisi Ward Representative, Obed Mwale, has been released unconditionally by the Kapenguria Law Courts after spending time in police custody over allegations of financing criminal activities.
Mwale was arrested by armed police officers in Kitale on Monday, November 2, 2026, and transferred to Kapenguria Police Station in neighbouring West Pokot County.
Police reportedly accused him of financing criminal activities, mobilising groups to disrupt Kenya Kwanza rallies and planning to obstruct President William Ruto’s motorcade during his visit to Kitale on October 16.
Investigators subsequently sought the court’s permission to detain him for additional days to complete their investigations and prepare possible charges.
The investigating officer told Senior Principal Magistrate Kipchumba Kenei that Mwale was suspected of financing criminal activities and asked the court to allow police to continue holding him as investigations progressed.
However, Magistrate Kenei dismissed the prosecution’s application, ruling that insufficient grounds had been presented to justify his continued detention.
The court noted that investigators had not provided evidence showing that Mwale was likely to abscond or pose a threat to public safety. It consequently ordered his release without any conditions.
Speaking to journalists outside the Kapenguria Law Courts, Mwale’s lawyer, Kennedy Egesa, welcomed the ruling, saying the court had done justice to his client. He argued that investigators had failed to provide compelling reasons to justify continued detention or further legal action against him.
Mwale said he was surprised by the circumstances surrounding his arrest, claiming he did not understand why he had been arrested or linked to the allegations.
His arrest had attracted criticism from the Linda Mwananchi movement, which dismissed the police allegations as politically motivated and accused authorities of targeting leaders associated with Trans Nzoia Governor George Natembeya.
The movement also claimed the arrest was intended to intimidate Mwale and undermine his political ambitions ahead of the 2027 General Election, in which he is seeking the Trans Nzoia Senate seat against incumbent UDA Senator Allan Chesang.
Linda Mwananchi maintained that the arrest would not derail its political activities, insisting that its leaders should not be subjected to intimidation because of their political affiliations.
