Rose Mbithe Mulwa, her two children and two police constables have been charged with the murder of city lawyer Mathew Kyalo Mbobu.

The five accused persons were arraigned before the Kibera High Court, where they appeared before Lady Justice Diana Kavedza and pleaded not guilty to the murder charge.

According to the Director of Public Prosecutions (DPP), the accused allegedly murdered Mbobu on September 9, 2025, at approximately 7:30 p.m. along Magadi Road in Karen, Lang’ata Sub-County, Nairobi, jointly with other individuals who have not been brought before the court.

The accused include Rose Mbithe’s children, Chris Mulwa and Angela Mulwa, alongside police constables Julius Kipkoech Cheruiyot and Kennedy Kipkemoi Borboroi.

The case marks the second murder charge against Rose Mbithe and her two children, who are also facing charges in connection with the killing of Dr. Victoria Mutiso.

The prosecution also informed the court of its intention to charge Police Inspector Kenneth Sang in connection with Mbobu’s murder.

Sang was arrested in Eldoret and presented before the Milimani Law Courts on Monday. The court authorised his continued detention for 14 days to allow the Directorate of Criminal Investigations (DCI) to complete its investigations.

The prosecution was directed to file an affidavit opposing the accused persons’ release on bond. The court scheduled November 24, 2026, for the hearing of the bond application.

Until his death, Mbobu was a prominent advocate of the High Court, university lecturer and author.

The murder case will proceed as the court considers the bond applications and further proceedings against the accused.

The court’s directions set the stage for the next phase of the proceedings, with the prosecution expected to present its arguments against bond as investigations into other possible suspects continue.

The accused remain presumed innocent until proven guilty by a court of law.

The court will determine the next steps after hearing submissions from both the prosecution and defence on the bond application.
