Foxcapital Investment Limited has been given 14 days to secure new legal representation after the High Court allowed Nyachoti & Company Advocates to withdraw from its Sh145 billion dispute with KCB Bank (Kenya) Limited.

Lady Justice Rhoda Rutto approved the law firm’s application, filed on September 10, 2026, during a court mention on September 17.

The firm, through lawyer Phillip Nyachoti, told the court it had faced difficulties obtaining further and sufficient instructions from Foxcapital after KCB filed its response and supporting affidavits.

Nyachoti & Company Advocates had sought the court’s permission to stop representing the company and also asked for directions on the costs of the application.

In her order, Justice Rutto stated: “The application to cease acting dated 10th September 2026 is hereby allowed.”

Following the ruling, Foxcapital has 14 days to regularise its legal representation as the dispute with KCB continues.

The case will return to court on October 27, 2026, for further directions on how it will proceed.
