Two men have been sentenced to death after being found guilty of four counts of robbery with violence in Moyale, Marsabit County.
Nashon Ochieng Agutu and Jackson Okech Odhiambo were convicted following a full trial at the Moyale Law Courts.
Senior Principal Magistrate Willy Cheruiyot found the two guilty on all four counts, which were brought under Section 295 as read with Section 296(2) of the Penal Code.
The charges stemmed from a robbery on April 23, 2025, in the Dabel area of Moyale Sub-County.
The prosecution said Agutu and Odhiambo, acting together with others and armed with dangerous weapons, including guns, attacked four people — Alinoor Mamo, Silas Kalunge, Linus Murithi Marinda and Bruno Thomas.
The victims were robbed of cash, mobile phones and other personal belongings during the attack.
They were also assaulted and sustained injuries.
Prosecution Counsel Benard Leadi called 13 witnesses during the trial to establish the case against the two accused persons.
After considering the evidence, the court found Agutu and Odhiambo guilty on all four counts.
In passing sentence, Magistrate Cheruiyot considered the circumstances of the robbery, the brutality of the attack and the use of lethal weapons.
“The court has taken into account the nature of the robbery attack, its brutality and the use of lethal weapons. A deterrent sentence is warranted. I sentence the two to death,” the magistrate ruled.
The two men were granted 14 days to appeal against both their conviction and sentence.
