Justice Diana Kavedza has denied bail to eight suspended Utumishi Girls students facing murder charges, ruling that their release at this stage could compromise the integrity of the trial and undermine the administration of justice.
In her analysis and determination, Justice Kavedza said the circumstances surrounding the case raised concerns that warranted the minors remaining in custody as the matter proceeds.
The judge also found that their immediate release could expose the minors to harm.
“This court finds that the immediate release of the minors exposes them to harm,” Justice Kavedza ruled.
The court further held that releasing the accused at this stage could potentially interfere with the judicial process and affect the integrity of the ongoing proceedings.
The eight minors are facing 16 counts of murder arising from an incident that led to their arrest and subsequent suspension from Utumishi Girls.
They had applied to be released on bail pending the hearing and determination of the case.
However, the court dismissed the bail application, citing the circumstances of the case and the need to safeguard the integrity of the proceedings.
The court directed that the minors be transferred to Kamae Borstal Institution within the Kamiti prison complex, where each is to be provided with an individual bed and cubicle.
Justice Kavedza also directed that the parents be allowed to have contact with their children once every month.
