A Nairobi court has rejected an application by the Office of the Director of Public Prosecutions (ODPP) seeking to detain two suspects for 30 days over the murder of Dr Victoria Nthunya Mutiso.
Police Constable (PC) Collins Bett and Pius Muiru Mbugua, alias “Headboy”, are facing murder charges under Section 203 as read with Section 204 of the Penal Code.
According to the charge sheet, the prosecution alleges that the two, together with others who have not been brought before the court, murdered Dr Mutiso on July 29, 2026.
The alleged incident occurred at about 9:30 a.m. along Mawensi Road in Kilimani Sub-County, Nairobi County.
The ODPP had asked the court to allow the suspects to remain in custody for 30 days to facilitate ongoing investigations. The prosecution also sought time to have the two suspects undergo mental assessments.
However, the request was opposed, with the defence arguing that the proposed 30-day detention period was unreasonable.
Justice Alexander Muteti declined to grant the full 30-day detention period, directing that the suspects be taken for mental assessment by October 5.
The judge further directed that the matter be mentioned alongside a related case for plea taking after the mental assessment is completed.
Justice Muteti also indicated that the suspects could be taken to a remand facility, noting the need to ensure equality and avoid complaints regarding their treatment while in custody.
