Businesswoman Caroline Lihavi Imbayi has been charged with conspiracy to defraud a Nairobi woman of KSh17 million in a case involving an alleged promise to supply herbicides.
Imbayi appeared in court to face a charge of conspiracy to defraud contrary to Section 317 of the Penal Code. She denied the charge and was released on a cash bail of KSh300,000.
According to the charge sheet, Imbayi allegedly conspired with other individuals who have not been brought before the court to obtain the money from Winfred Kawira Micheni by falsely claiming she could supply herbicides.
The alleged offence is said to have occurred on diverse dates between March 18 and June 20, 2024, in the Buruburu and Embakasi areas of Nairobi County.
The prosecution alleges that Imbayi made the representation knowing it was false, with the intention of defrauding Micheni of the KSh17 million.
The case centres on the alleged business arrangement in which the accused is said to have presented herself as being capable of supplying the agricultural chemicals.
Herbicides are used to control unwanted plants and weeds, making them an important input in agricultural production.
However, the charge against Imbayi remains an allegation, and the prosecution will be required to prove its case in court. Her plea of not guilty means the matter will proceed through the legal process.
The court granted her cash bail of KSh300,000 as she awaits the next stage of the proceedings.
The matter is scheduled for mention on November 3, 2026, when it will be considered for consolidation with related cases.
Consolidation would allow the court to consider related matters together where appropriate, depending on the court’s directions.
The upcoming mention is expected to determine the way forward in the proceedings, including how the case will be handled alongside the related matters.
Imbayi remains presumed innocent unless and until she is proved guilty by a court of law.
