Businessman Mandeep Singh Channa has been charged with allegedly forging company documents used in the resignation of a director and transfer of shares at Channa Investments Limited.
Prosecutors allege that Channa, together with other people who have not been charged, prepared an affidavit dated October 19, 2022, which was presented as having been sworn by Supinderpaul Singh before advocate and Commissioner for Oaths Esther Asati.
The document was allegedly uploaded to the Business Registration Service (BRS) through Channa’s eCitizen account on October 25, 2022. Prosecutors say it was used to process Supinderpaul Singh’s purported resignation as a director of the company.
Channa is also accused of preparing and using minutes dated October 19, 2022, which were presented as records of a company board meeting which were later submitted to the BRS through Channa’s eCitizen account.
Another charge relates to a resignation letter dated October 19, 2022. Prosecutors claim the letter was made to appear as though it had been signed by Supinderpaul Singh and was later submitted to the BRS to support his alleged resignation.
The case also involves 4,000 ordinary shares in Channa Investments Limited that were allegedly transferred from Supinderpaul Singh to Channa and that he prepared a share transfer document dated July 3, 2023, showing the shares had been transferred to him.
The document was allegedly uploaded to the BRS through his eCitizen account on July 25, 2023, despite him knowing it was allegedly false.
Channa also faces a charge over another affidavit dated July 25, 2023, which prosecutors allege was falsely presented as having been sworn by Supinderpaul Singh before Asati.
The prosecution says the affidavit was submitted through the BRS system and used to support the disputed share transfer.
Channa denied the allegations and pleaded not guilty to all the charges and was released on a KSh300,000 cash bail as the case continues.
