The Director of Public Prosecutions (DPP) has secured life imprisonment sentences for three men convicted of robbery with violence and gang rape in Nyeri County.
Samuel Kabutu Kiunuhe, Michael Ndungu Kiritu and Daniel Muraguri Wangari were convicted over an incident that occurred on April 11, 2023, in the Kiamwathi area of Nyeri County.
The three were charged with robbery with violence under Section 296(2) of the Penal Code after they robbed a complainant of several household items while armed with a knife and subjected her to violence.
Kiunuhe and Kiritu were also charged with gang rape under Section 10 of the Sexual Offences Act, while Wangari faced the same charge based on common intention.
During the trial, the prosecution, led by Counsel Ms. Obat, presented evidence from seven witnesses.
The court heard that the complainant identified the perpetrators. DNA analysis conducted by the Government Chemist also matched samples collected from the complainant to Kiritu and Kiunuhe.
The court further found that the identification evidence presented against Wangari was sufficient to place him among the perpetrators.
Delivering the judgment at the Nyeri Chief Magistrate’s Court, Senior Resident Magistrate Mary Gituma found that the prosecution had proved the charges against all three men beyond reasonable doubt.
The court consequently convicted the three of robbery with violence and gang rape.
Each convict was sentenced to life imprisonment for robbery with violence and 20 years in prison for gang rape, with the sentences running concurrently.
The conviction and sentences underscore the role of the prosecution in pursuing serious criminal cases and securing justice for victims while upholding the rule of law.
