The High Court has given the Director of Public Prosecutions (DPP) 14 days to file its response in a case challenging the decision to prosecute three City Hall officials over the collapse of Manzil Towers in South C, Nairobi.
Justice Dr Nabil Orina issued the directions when the matter came up for mention to assess compliance with earlier court orders on filing of submissions.
The applicants have already filed and served their written submissions. They will have seven days to file supplementary submissions, if necessary, after receiving the DPP’s response.
The court will also consider an application seeking to consolidate the proceedings during the next mention.
The case will be mentioned on October 14, 2026, for further directions, confirmation of compliance and to set a date for judgment.
The proceedings stem from efforts by the Directorate of Criminal Investigations (DCI) to have the officials charged over the collapse of Manzil Towers C.
In July, the High Court temporarily barred the arrest, charging and prosecution of Patrick Analo Akivaga, David Kibui Kigathi and another applicant, allowing them to challenge the decision to institute criminal proceedings against them.
Through lawyer Danstan Omari, the applicants are contesting the intended charges, which relate to alleged abuse of office under Sections 101(1) and 102A of the Penal Code.
They are seeking, among other orders, the quashing of the decision to prosecute them.
