A woman has been charged before a Mombasa court over an alleged land fraud involving two parcels of land in Shelly Beach, Likoni, valued at Sh100 million.

Farzana Nur Butt appeared before Senior Resident Magistrate Gladys Olimo, where she denied three charges relating to the alleged fraudulent acquisition and registration of land belonging to Susan Wanjiru Kangethe.

In the first count, Butt was charged with conspiracy to defraud, contrary to Section 317 of the Penal Code, alongside other suspects who were not before the court.

The prosecution alleged that they conspired to defraud Kangethe of parcels of land registered as LR. Mombasa/MS/Block I/1944 and Mombasa/MS/Block I/1945 between July 12, 2006, and October 20, 2026.

The two parcels, registered at the Mombasa Land Registry and valued at Sh100 million, were allegedly claimed without the authority of the registered owner.

The court heard that Butt allegedly caused the property to be registered in the names of her relatives, Jamshed Ahmed Butt and Fahmeda Begum Butt, despite allegedly knowing that the registration was based on false information.

In the second count, she was charged with obtaining registration of land by false pretences, contrary to Section 320 of the Penal Code.

The prosecution alleged that on July 12, 2006, Butt fraudulently inserted Title Lease No. Mombasa/MS/Block I/416 into the land records at the Mombasa Land Registry, intending to deprive Kangethe of the two parcels situated in Shelly Beach, Likoni.

She also faced a third charge of forcible entry, contrary to Section 90 of the Penal Code.

The prosecution alleged that she unlawfully entered the premises without the registered owner's authority on diverse dates between July 9, 2025, and October 20, 2026, with the intention of annoying the owner.

Butt pleaded not guilty to all three charges.

Through her lawyer, she asked the court to release her on reasonable bond terms, arguing that she had a fixed place of residence within the court's jurisdiction.

Assistant Director of Public Prosecutions Breda Ogada, who prosecuted the case, urged the court to impose bond terms commensurate with the charges.

Magistrate Olimo ordered Butt's release on a bond of Sh1 million, with a surety of a similar amount.

The court scheduled the matter for a pre-trial conference on November 12, 2026.
