A Narok man has been sentenced to life imprisonment after being convicted of defiling his 10-year-old daughter in a case that has highlighted the grave violation of trust within a family.
The sentence was secured by the Office of the Director of Public Prosecutions (ODPP) following a successful prosecution at the Narok Law Courts.
Chief Magistrate H. Nyaberi handed down the sentence after finding that the prosecution had proved its case beyond reasonable doubt. The case was prosecuted by Prosecution Counsel Leone Wandera.
The court heard that the offence was committed on diverse dates between 2024 and February 2026 in the Bulla Kipangas area of Narok Central Sub-County.
During the trial, the prosecution presented evidence from four witnesses, alongside the testimony of the minor, who identified the accused as her father and placed him at the scene of the crime.
The court also relied on medical evidence presented during the proceedings, including a P3 form and treatment notes, which corroborated the child's account.
In delivering the judgment, Magistrate Nyaberi condemned the accused's actions, particularly given his position of trust and responsibility as the child's father.
“The court has considered the offence and the relationship between the accused and the complainant. This is a father and daughter relationship and as such, the accused was required to protect her, but instead he is the one who preyed on her,” the magistrate ruled.
The court further noted that the victim was below the age of 11 at the time of the offence, a factor that informed the sentence under Section 8(2) of the Sexual Offences Act.
The provision prescribes life imprisonment for a person convicted of defiling a child aged 11 years or below.
The conviction followed the court's assessment of the child's testimony, witness accounts and medical documentation, which collectively supported the prosecution's case.
The ruling underscores the legal responsibility of parents and guardians to protect children from abuse and the consequences faced by perpetrators of sexual offences against minors.
