A lawyer has vowed to pursue further legal action over alleged paternity fraud after a DNA test established that a man who had supported a child for about seven years was not the minor’s biological father.
Lawyer Shadrack Wambui told the court that his client was devastated by the findings, having invested in the child’s upbringing and education for years under the belief that he was the biological father.
The DNA report, dated August 12, 2026, was presented in court, with the findings conclusively excluding the man, whose identity has been withheld, as the child’s biological father.
“The conclusion is that xxxxxx is excluded as the biological father to the child,” the court was told as the results of the DNA analysis were read out.
Reacting to the findings, Wambui said his client was dissatisfied with the outcome and was considering further legal action against the respondent over what he described as paternity fraud.
“My client has been a victim of paternity fraud for the last about seven years and counting,” the lawyer told the court, expressing his client’s frustration over the revelations.
Wambui said his client had dedicated significant resources to the child’s welfare, including providing education and other necessities, believing he was fulfilling his responsibilities as the biological father.
“We have educated this child, Your Honour. We have given him everything,” he said, highlighting the emotional and financial toll the findings had taken on his client.
The lawyer indicated that his client would be advised on the appropriate legal steps to take against the respondent over the alleged deception.
However, he did not specify the nature of the additional legal action being considered.
Following the DNA findings, Wambui applied to have the ongoing proceedings withdrawn, arguing that the test results had resolved the central question that had brought the parties before the court.
He also requested a copy of the DNA report to enable his client to review the findings and obtain guidance on his legal position concerning the minor.
“We will be applying with humility that these proceedings be marked as withdrawn. Further, we will be praying that you furnish us with a copy of that DNA report so that we can serve it upon our client, who will be guided factually as to his legal status,” Wambui told the court.
The lawyer further apologised to the court over the lengthy proceedings, revealing that the dispute had taken approximately two years to litigate.
Despite the outcome, he thanked the court for its assistance in handling the matter, which had centred on establishing the biological paternity of the child.
