A 36-year-old man has been sentenced to 20 years in prison after being convicted of defiling a 12-year-old girl in Seme Sub-County, Kisumu County.

Kombewa Magistrate’s Court, presided over by Hon. Jocelyn R. Kimetto, found Ng’iendo guilty of the offence committed on May 18, 2022, at around midday.

The court heard that the girl had returned home from school because she was feeling unwell and wanted to seek treatment.

She was staying at her aunt’s home, where the accused lived with his wife and their three children.

According to evidence presented in court, the man carried the girl from the living room to a bedroom and sexually assaulted her.

The prosecution told the court that he had abused the child on three previous occasions and threatened to kill her if she disclosed the incidents.

The girl later told her aunt what had happene and her aunt later took her to hospital for examination before reporting the matter to police.

Principal Prosecution Counsel Carolyn Kiptum led the prosecution, which called three witnesses to prove the case.

One of the witnesses was a clinical officer whose examination findings were consistent with the allegations presented in court.

Ng’iendo denied the charges, including an alternative count of committing an indecent act with a child and in his defence, he claimed that his wife had framed him.

However, Magistrate Kimetto rejected his explanation, saying it did not make sense and did not cast doubt on the prosecution’s case.

The court subsequently convicted him of defilement under Sections 8(1) and 8(3) of the Sexual Offences Act and sentenced him to 20 years in prison.

The sentence followed the prosecution’s presentation of witness testimony and medical evidence to support the charge.

The court granted Ng’iendo 14 days to appeal the conviction and sentence and urged people to always report all the crimes without any fear of being judged.
