Businessman Brian Kipruto Koech has been charged with obtaining Sh11.4 million by false pretences and two counts of dealing with alleged proceeds of crime.
Koech appeared before the Milimani Law Courts, where he denied all three charges. The court released him on a cash bail of Sh3 million, with two sureties of a similar amount.
The prosecution alleges that Koech committed the offences between January 29 and March 17, 2026, in Nairobi County, jointly with others who have not been brought before the court.
According to the charge sheet, Koech allegedly obtained Sh11,408,000 from Abdalla Faraj Abdalla by falsely claiming that he could purchase cereals, sell them on Abdalla’s behalf and return the profits.
The alleged offence took place in Nairobi’s Central Business District and is contrary to Section 313 of the Penal Code, which deals with obtaining money by false pretences.
Koech also faces charges of acquiring and using proceeds of crime under the Proceeds of Crime and Anti-Money Laundering Act, No. 9 of 2009.
In the second count, the prosecution alleges that Koech received the Sh11.408 million from Abdalla through his Absa Bank account on various dates between January 29 and March 17, 2026, despite allegedly knowing or having reasonable grounds to believe that the money was proceeds of crime.
The third count relates to the alleged use of the same funds held in his Absa Bank account.
The charge sheet states that Koech allegedly used the money on various dates between January 17 and March 17, 2026, in Nairobi County, while knowing or having reasonable grounds to believe that the funds were proceeds of crime.
The charges remain allegations, and Koech is presumed innocent unless proven guilty by a court of law.
The case will proceed under the applicable anti-money laundering laws, with the prosecution required to prove the allegations against Koech beyond reasonable doubt during the trial.
